A Rent Agreement which is also known as leave and license agreement, is a type of contract usually written between the owner of a property (Licensor) and the tenant (Licensee), who desire to rent the property on temporary possession as distinguished in the agreement.
This agreement contains the terms and conditions as decided by the Licensor and Licensee, that are agreement starting and ending date, total duration, rent amount, deposit amount, lock in period, usage of premises, the notice period for termination or dispossession of the premises, list of furniture and fixture and maintenance of the rented property etc.

Online Rent Agreement Registration is the program implemented by Department of Registration and Stamps of Maharashtra Govt. through which citizens can do Online Rent Agreement Registration without going physically to Sub-Registrar Office. The provisions relating to standard rent and permitted increases shall not apply to any premises let or given on license in a building, whether newly constructed or otherwise where such premises were not let or given on license for a continuous period of one year.

A licensee (tenant) has the right only to occupy and use the property as a mere licensee. A licensee cannot transfer his right over the property and also does not have exclusive possession of the property. The legal possession of the property is deemed to be that of the licensor.

Any licensee who does not deliver possession of the premises to the landlord/owner on expiry of the period of license and continues to be in possession of the licensed premises till he is dispossessed by the Competent Authority shall be liable to pay damages at double the rate of the license fee or charge of the premises fixed under the agreement of license.

A licensee in possession or occupation of premises given to him on license for residence shall deliver possession of such premises to the landlord on expiry of the period of license; and on the failure of the licensee to so deliver the possession of the licensed premises, a landlord shall be entitled to recover possession of such premises from a licensee, on the expiry of the period of license, by making an application to the Competent Authority, and, the Competent Authority, on being satisfied that the period of license has expired, shall pass an order for eviction of a licensee.

Any person who is legally entitled to enter into a contract can rent a property under leave and license.

Notice Period Clause details the conditions by which owner or tenant can give notice to each other regarding the cancellation of the agreement. Parties can mutually decide the duration, generally it is 1 or 2 months, for the notice period and it can be conditional.

One should receive the registered agreement within 1 to 7 working days after bio-metric verification of all parties and submission of the same to the concerned authorities, subject to approval from the concerned authorities.
